Kobiton, Inc. (”Kobiton,” “we,” “us,” or “our”) provides the Kobiton website at www.kobiton.com, related websites and online properties that link to this Privacy Policy, and the Kobiton platform, applications, APIs, support services, AI-enabled features, integrations, and related offerings (collectively, the “Services”).

This Privacy Policy explains how we collect, use, disclose, and otherwise process personal information:

  • when you visit our websites;
  • when you interact with us offline;
  • when you create, administer, or use a Kobiton account;
  • when you use the Kobiton Services; and
  • when you communicate with us for support, sales, events, or other business purposes.

If you use the Services on behalf of an organization, that organization may control how the Services are configured and how certain personal information is processed. In those cases, Kobiton may act as a processor or service provider on behalf of the organization for data processed through the Services, and the organization acts as the controller or business for that data.

1. Scope

This Privacy Policy applies to personal information processed by Kobiton in connection with the Services, including both:

  • the Kobiton website and related marketing activities; and
  • the Kobiton product and service.

This Privacy Policy does not apply to:

  • third-party websites, services, or applications that do not link to this Privacy Policy;
  • information processed by customers where Kobiton acts solely on the customer’s instructions, except as described here regarding our role as a processor or service provider; or
  • information subject to a separate agreement, privacy notice, or data processing addendum.

2. Personal Information We Collect

We collect personal information from you, from your organization, automatically from your use of the Services, and from third parties.

A. Information you provide directly

We may collect:

  • name, business email address, phone number, job title, company name, and mailing address;
  • account credentials and profile information;
  • billing, payment, and transaction information;
  • information you submit through forms, chat, support tickets, surveys, event registrations, or sales inquiries;
  • content you upload, submit, or make available through the Services, including files, screenshots, logs, prompts, support materials, and feedback;
  • communications you send to us.

B. Information we collect automatically

We may collect:

  • IP address, device identifiers, browser type, operating system, device characteristics, language, and approximate location derived from IP address;
  • usage information, including pages viewed, links clicked, referral URLs, session duration, timestamps, crash data, and interaction data;
  • service telemetry, diagnostic data, and performance information;
  • cookie, pixel, SDK, and similar tracking information.

C. Information we receive from third parties

We may receive personal information from:

  • your employer or organization;
  • single sign-on or identity providers;
  • payment processors;
  • resellers, partners, and referral sources;
  • marketing and analytics providers;
  • event organizers; and
  • third-party platforms and integrations you or your organization choose to connect to Kobiton.

D. Categories of personal information

Depending on how you interact with us, we may collect the following categories of personal information:

  • identifiers and contact information;
  • commercial and billing information;
  • internet or electronic network activity information;
  • device and system information;
  • geolocation data derived from IP address;
  • professional or employment-related information;
  • audio, visual, or electronic information you submit to us;
  • customer content and support materials; and
  • inferences derived from the above, such as preferences or product interest.

Kobiton does not intentionally collect consumer personal information through the Services for its own business purposes. However, customers may upload or process data through Kobiton that contains personal information, including consumer personal information, and in those cases Kobiton processes that data on the customer’s behalf in accordance with applicable agreements and law.

3. How We Use Personal Information

We use personal information for the following purposes:

To provide and operate the Services

  • create and administer accounts;
  • authenticate users;
  • provide product functionality;
  • process transactions and payments;
  • deliver customer support; and
  • maintain business records.

To secure, maintain, and improve the Services

  • monitor availability, performance, reliability, and security;
  • debug, troubleshoot, and prevent fraud, abuse, and misuse;
  • perform quality assurance, analytics, and internal reporting; and
  • develop, improve, and optimize features, workflows, and user experience.

To communicate with you

  • respond to inquiries and requests;
  • send administrative, transactional, service, and support communications;
  • send marketing communications where permitted by law; and
  • manage events, webinars, promotions, and business relationships.

To provide AI-enabled functionality

Where you or your organization uses Kobiton AI-enabled features, Kobiton may process screenshots, logs, view trees, prompts, instructions, metadata, and related outputs as necessary to:

  • provide the requested feature;
  • generate responses, summaries, analyses, recommendations, or automations;
  • monitor performance, safety, and reliability of the feature; and
  • improve Kobiton’s AI-enabled product functionality, safety, and service quality, subject to contractual commitments and applicable law.
  • comply with applicable law, regulation, court order, subpoena, or legal process;
  • enforce our agreements and policies; and
  • protect the rights, safety, property, and security of Kobiton, our customers, users, and others.

If you are located in the EEA, UK, or Switzerland, we process personal information on one or more of the following legal bases:

  • performance of a contract;
  • compliance with a legal obligation;
  • our legitimate interests, such as operating, securing, improving, and marketing the Services, where those interests are not overridden by your rights; or
  • your consent, where required by law.

5. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients:

Service providers and subprocessors

We disclose personal information to vendors and service providers that perform services on our behalf, such as hosting, infrastructure, payment processing, customer support, analytics, communications, security, and professional services.

Integration and platform partners

If you or your organization enable integrations, we may disclose information to the third-party services necessary to operate those integrations.

AI and model providers

If you or your organization uses AI-enabled features, Kobiton may disclose data necessary to provide those features to third-party AI or model providers. This may include screenshots, logs, view trees, prompts, instructions, metadata, and related outputs to the extent needed to provide the feature.

Corporate transactions

We may disclose personal information in connection with an actual or proposed merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction.

We may disclose personal information to courts, regulators, law enforcement, government authorities, or other third parties where required by law or where we believe disclosure is necessary to protect rights, safety, security, or property.

We may disclose personal information when you direct us to do so or otherwise consent.

6. Sales, Sharing, and Targeted Advertising

Kobiton does not sell personal information for money.

However, Kobiton uses advertising, analytics, and similar technologies on its website, and depending on the jurisdiction, this may be considered “sharing,” “targeted advertising,” or similar regulated processing. Where required by law, Kobiton provides notice, consent, and opt-out choices through its cookie and privacy tools.

7. Cookies and Similar Technologies

We use cookies, pixels, SDKs, local storage, and similar technologies to:

  • keep you signed in;
  • remember your preferences;
  • analyze traffic and usage;
  • secure and improve the Services; and
  • support marketing, advertising, and retargeting activities where permitted by law.

Where required by law, we obtain consent before using non-essential cookies or similar technologies. You can manage cookie preferences through our cookie banner, privacy tool, or browser settings. Some parts of the Services may not function properly if cookies are disabled.

8. AI Features and Model Training

Kobiton offers AI-enabled features within the Services. When you or your organization uses those features:

  • Kobiton may process screenshots, logs, view trees, prompts, instructions, metadata, and outputs to provide the feature;
  • Kobiton may use trusted service providers, including AI or model providers, to process that data on Kobiton’s behalf or as directed by the customer;
  • Kobiton does not use enterprise customer content to train Kobiton’s own models in a way that identifies a customer or individual user; and
  • where Kobiton provides a feature that relies on a third-party AI provider, the use of data for that feature is subject to Kobiton’s agreements, applicable law, and the technical requirements of that feature.

9. International Data Transfers

Kobiton is headquartered in the United States, and Kobiton and its service providers may process personal information in the United States and other countries where Kobiton or its providers operate.

Where required by law, Kobiton uses appropriate safeguards for cross-border transfers, such as:

  • the European Commission’s Standard Contractual Clauses;
  • the UK International Data Transfer Addendum or equivalent mechanism; or
  • other lawful transfer mechanisms recognized under applicable law.

10. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including:

  • to provide the Services;
  • to maintain customer relationships;
  • to comply with legal, tax, accounting, and regulatory obligations;
  • to resolve disputes;
  • to enforce agreements; and
  • to secure and improve the Services.

Retention periods vary depending on the type of information, the context in which it was collected, the nature of the relationship, customer instructions, and legal requirements.

11. Security

Kobiton maintains administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure.

These measures may include access controls, encryption in transit and at rest where appropriate, logging and monitoring, vendor risk management, security reviews, and incident response procedures.

Kobiton maintains a SOC 2 Type II attestation.

No security measure is perfect, and Kobiton cannot guarantee absolute security. If Kobiton becomes aware of a security incident involving personal information, Kobiton will investigate and notify affected customers or individuals as required by applicable law and contractual obligations.

12. Your Privacy Rights and Choices

Depending on where you live, you may have the right to:

  • know whether we process your personal information;
  • access or obtain a copy of your personal information;
  • correct inaccurate personal information;
  • delete personal information;
  • restrict or object to certain processing;
  • withdraw consent where processing is based on consent;
  • request data portability;
  • opt out of targeted advertising, profiling in furtherance of decisions that produce legal or similarly significant effects, or certain sharing activities; and
  • appeal a denial of a privacy request where required by law.

You may also opt out of marketing emails by using the unsubscribe link in those emails. We may still send transactional or service-related messages.

13. Additional Notice for California Residents

If you are a California resident, this section applies to you.

Categories of personal information collected

In the preceding 12 months, Kobiton may have collected the following categories:

  • identifiers;
  • personal information described in Cal. Civ. Code § 1798.80;
  • commercial information;
  • internet or electronic network activity information;
  • geolocation data;
  • professional or employment-related information;
  • audio, visual, electronic, or similar information; and
  • inferences.

Kobiton collects personal information from:

  • you directly;
  • your employer or organization;
  • service providers and partners;
  • automatic collection technologies; and
  • third-party integrations and platforms.

Business and commercial purposes

Kobiton collects and uses personal information for the purposes described in Section 3 above.

Disclosure

Kobiton may disclose these categories of personal information to the recipient categories described in Section 5 above.

Sensitive personal information

Kobiton does not use or disclose sensitive personal information for purposes that require a separate right to limit use under California law, except as permitted by law.

California rights

California residents may request to:

  • know the categories and specific pieces of personal information Kobiton collected;
  • know categories of sources, purposes, and disclosures;
  • delete personal information;
  • correct inaccurate personal information; and
  • opt out of certain sharing or targeted advertising activities.

14. Additional Notice for Residents of Other U.S. States

Residents of certain U.S. states may have privacy rights similar to those described above, including rights to access, delete, correct, portability, opt out of targeted advertising, opt out of certain profiling, and appeal our decisions. Kobiton will honor applicable rights requests in accordance with the law that applies to your residence.

15. Additional Notice for EEA, UK, and Switzerland

If you are located in the EEA, UK, or Switzerland, you may have the right to:

  • access your personal information;
  • request correction or deletion;
  • object to processing;
  • request restriction of processing;
  • request portability;
  • withdraw consent at any time where processing is based on consent; and
  • lodge a complaint with your local supervisory authority.

16. Data Processing Terms and Subprocessors

Where Kobiton processes personal information on behalf of customers as a processor or service provider, Kobiton’s data processing terms are available in customer agreements and related service terms.

17. Third-Party Services

The Services may contain links to third-party websites, services, plug-ins, or integrations. Kobiton is not responsible for the privacy practices of third parties, and users should review the applicable privacy notices of those third parties.

18. Children’s Privacy

The Services are intended for business use and are not directed to children under 16. Kobiton does not knowingly collect personal information from children under 16. If you believe a child has provided personal information to Kobiton, contact legal@kobiton.com and Kobiton will take appropriate steps.

19. Changes to This Privacy Policy

Kobiton may update this Privacy Policy from time to time. When Kobiton does, it will revise the “Last Updated” date above. If required by law, Kobiton will provide additional notice or obtain consent for material changes.
